Join us for an insightful discussion on the New NYS Part 375 Remedial Program Draft Regulations.  

The New York State Department of Environmental Conservation (DEC) released the second revision to the proposed amendment to 6 NYCRR Part 375, Environmental Remediation Programs.  This rule-making amends Part 375, Environmental Remediation Programs, to conform with both the 2015 and 2022 Amendments with respect to the Brownfield Cleanup Program (BCP).  It also addresses and enhances requirements pertaining to the State Superfund Program and the Environmental Restoration Program (ERP); and updates the soil cleanup objectives (SCOs) based on review and comments received by DEC staff and the New York State Department of Health. The rule-making also amends Part 375 to incorporate needed changes, clarifications, and modifications to the regulations based on the experience developed during the first decade of implementing the BCP.
